General terms and conditions for visitors
1. General provisions: Definitions
1.1 De Hallen Amsterdam: the spaces open to the public in the De Hallen Amsterdam complex on the Hannie Dankbaarpassage in Amsterdam.
1.2 Visitor: anyone who enters De Hallen Amsterdam.
1.3 Officers of De Hallen Amsterdam: all natural persons working in and around De Hallen Amsterdam on behalf of De Hallen Amsterdam.
2. Applicability
2.1 These terms and conditions apply to all visitors to De Hallen Amsterdam and also to all natural persons and/or legal entities that De Hallen Amsterdam uses or has made use of for its purpose.
2.2 Deviations from these terms and conditions are only valid if they have been expressly agreed in writing.
3. Access to De Hallen Amsterdam
3.1 De Hallen Amsterdam is accessible to everyone. Within the set opening hours and provided that the house rules are followed. Some activities (performances, workshops, film screenings, etc.) require an admission ticket. Without a valid admission ticket, entry may be refused.
3.2 De Hallen Amsterdam is entitled to adapt regular opening hours to occasional exercises in the context of business assistance (article 23 Working Conditions Act) or, in the event of an actual calamity, to a complete or partial evacuation of De Hallen Amsterdam deemed necessary. Such an adjustment to the regular opening time does not entitle the Visitor to a refund of any admission fee paid.
4. Stay at De Hallen Amsterdam
4.1 The Visitor's stay in De Hallen Amsterdam is at the Visitor's own expense and risk.
4.2 During the stay in De Hallen Amsterdam, the visitor will behave in accordance with safety regulations and public order. The visitor is also obliged to immediately follow the instructions and instructions given by De Hallen Amsterdam officials who are recognisable as such. If, in the opinion of this officer, a Visitor acts in any way in violation of these regulations, standards, instructions and instructions, he or she may be denied further access to De Hallen Amsterdam without De Hallen Amsterdam being obliged to pay compensation for any damage.
4.3 Visitor is liable for any damage caused by a (similar) object that he/she has brought into De Hallen Amsterdam.
4.4 In the event of emergencies, for example a terrorist attack or violence of a different order, De Hallen Amsterdam is entitled to close its doors and then lead visitors out one by one. Visitor can then be asked to cooperate in the visitation of bags and the like by or on behalf of the staff of De Hallen Amsterdam. Visitor may also be asked to grant permission for a search. Visitors who refuse to cooperate with visitation and/or search will be asked to provide proof of identity before leaving De Hallen Amsterdam.
5. Code of Conduct
5.1 In De Hallen Amsterdam, visitors will:
a. do not offer goods/services of any kind to third parties for sale without permission or provide them free of charge;
b. do not interfere with other visitors;
c. no smoking;
d. do not consume alcohol in the central walk-through hall, except in the cafe/restaurant;
e. do not use soft/hard drugs within the complex;
f. do not touch exhibited objects unless this is explicitly and explicitly allowed;
g. do not make photo, video and film recordings using lamps, flash equipment and/or tripods without the prior written permission of De Hallen Amsterdam;
h. do not draw or paint without prior written permission from De Hallen Amsterdam;
i. do not sleep in areas within the complex.
5.2 Parents or teachers or supervisors are at all times responsible for and accountable for the behavior of minors, individuals or groups brought or accompanied by them.
5.3 Photos, video and/or film recordings taken in De Hallen Amsterdam may not be used for commercial purposes except with the express written permission of De Hallen Amsterdam.
6. Liability
6.1 De Hallen Amsterdam is only liable for damage suffered by the Visitor that is a direct result of gross negligence or intent on the part of De Hallen Amsterdam, and
a. up to the amount paid by De Hallen Amsterdam's insurer to De Hallen Amsterdam in respect of the damage, or
b. the compensation paid to De Hallen Amsterdam by a third party.
6.2 Liability of De Hallen Amsterdam for indirect damage, including consequential damage, lost profit or salary, missed savings, etc., is excluded at all times.
7. Force majeure
7.1 Force majeure for De Hallen Amsterdam, which means that any shortcoming caused by it cannot be attributed to De Hallen Amsterdam, will be any foreseeable or unforeseeable circumstance that complicates the execution of the agreement by De Hallen Amsterdam to such an extent that, temporarily or permanently, the execution of the agreement becomes impossible or difficult.
7.2 Such circumstances include circumstances involving persons and/or services and/or institutions that De Hallen Amsterdam wishes to make use of when executing the visiting agreement, as well as everything that counts as force majeure or a suspensive or dissolving condition for the aforementioned, as well as an attributable shortcoming on the part of the aforementioned.
8. Found items
8.1 Items found by Visitors in De Hallen Amsterdam can be handed over to an employee.
8.2 De Hallen Amsterdam will temporarily store found items and, in the case of valuable items, transfer them to the police in Amsterdam.
8.3 In the event that the alleged owner of a found object reports, he has the choice to pick up the goods himself or have them sent cash on delivery. In both cases, the owner must be able to identify himself properly. In case of doubt on the part of De Hallen Amsterdam about the status of the alleged owner, De Hallen Amsterdam is entitled to require proof of ownership.
9. Complaints procedure
9.1 In the event of complaints, Visitor can make them known by means of an appropriate contact form on our website.
9.2 The Visitor's complaint will be investigated and answered in writing within 30 days.
10. Other terms and applicable law
10.1 The applicability of these General Terms and Conditions for Visitors does not affect the possible applicability of other contractual terms and/or regulations of De Hallen Amsterdam.
10.2 These General Terms and Conditions for Visitors and the agreement between Visitor and De Hallen Amsterdam are governed by Dutch law. Disputes arising from the agreement between the Visitor and De Hallen Amsterdam will be submitted to the competent court in Amsterdam.
